Based on oral and written comments submitted at the April 5, 2006, Commission hearing on the Final Environmental Impact Report, the following supplemental information is provided as an Addendum to the Executive Officer's Report on the proposed Sacramento Municipal Utility District Sphere of Influence Amendment and Annexation of Territory in Yolo County (05-05) dated April 20, 2006. The attached documents listed below are to be considered attachments to the Executive Officer's Report dated April 20, 2006.

A. Pacific Gas & Electric Company position paper. E-mailed from Joyce K. Kazama April 12, 2006, to Peter Brundage.
B. Opinion from Nancy Miller, Miller, Owen and Trost, dated April 13, 2006 in response to April 5, 2006 hearing.

1. Final EIR is adequate in its discussion of tiering the project and the Stanislaus Natural Heritage case does not require a different analysis.
2. The election on the proposed annexation is subject to a majority vote of the territory to be annexed.

C. Opinion, Steven F. Greenwald, Davis, Wright, Tremain dated April 6, 2006 regarding Response to PG&E comments given April 5, 2006 regarding "Splitting the Difference" Valuation Theory.
D. GES Engineers and Appraisers Response to letter submitted by PG&E dated April 5, 2006, regarding GES Report.
E. Sacramento Municipal Utility District Response to Pacific Gas & Electric Company Comments on Valuation Report by GES Engineers and Appraisers, April 5, 2006.
F. URS Response to oral and written comments received on April 5, 2006, and to letter from Michael H. Zischke, Morrison/ Foerster, Comments on the Final for the proposed SMUD annexation. Correspondence dated April 10, 2006.
G. Legal Description of proposal territory. The boundary description of the proposal territory is under review by a licensed land surveyor. The final metes and bounds legal description will be consistent with the legal description submitted by SMUD in its application.
